Terms of Use

These terms govern your use of JourneyDeck’s website, iPhone and iPad apps, and related services.

Agreement and eligibility

By using JourneyDeck, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the service. You must be legally able to enter this agreement. JourneyDeck is not directed to children under 13.

Use JourneyDeck safely

JourneyDeck is a personal journal, not a navigation, emergency, vehicle-control, or safety system. Do not interact with the app while driving. Obey traffic laws, use lawful device-mounting and hands-free practices, and begin or end a recording only when it is safe.

Location, speed, route, map, vehicle, music, and place information can be delayed, incomplete, or inaccurate. Do not rely on JourneyDeck to make driving, navigation, charging, emergency, insurance, legal, or financial decisions.

Your archive and content

You retain ownership of the journeys, labels, notes, photos, and other content you add. You give JourneyDeck permission to process that content only as needed to provide features you request, such as displaying your archive, creating a share card, or syncing through an enabled service.

JourneyDeck is local first. You are responsible for maintaining device access and backups appropriate for you. Optional iCloud continuity depends on your Apple Account and Apple’s services. Features that export or share content are your choice; review the result before sending it to others.

You may not misuse JourneyDeck, interfere with its operation or security, probe nonpublic systems, infringe another person’s rights, upload unlawful content, or use the service to stalk, harass, or secretly monitor another person.

JourneyDeck Plus and purchases

JourneyDeck may offer paid features or subscriptions through Apple’s App Store. Available products, price, billing period, trial terms, and included features are shown before purchase. Apple processes payment. Unless the offer says otherwise, a subscription renews automatically until canceled through your Apple account settings before renewal.

Cancellation stops future renewal and does not ordinarily refund the current period. Refund requests are handled under Apple’s policies and applicable law. Restoring a purchase may require the same Apple Account used to buy it. Paid features may evolve, subject to applicable law.

Third-party services

Optional features may use services provided by Apple, including Apple Music, ShazamKit, Maps, iCloud, Sign in with Apple, and the App Store, as well as other disclosed map, vehicle, update, or diagnostics providers. Those services are governed by their own terms and availability. JourneyDeck is not responsible for a third-party service’s outage, content, or independent conduct.

If you download JourneyDeck from Apple’s App Store, Apple’s applicable licensed-application terms also apply. Apple is not responsible for providing JourneyDeck support.

JourneyDeck ownership and license

JourneyDeck, its software, design, branding, and original content are owned by the developer or licensed to the developer. Subject to these terms, you receive a personal, limited, nonexclusive, nontransferable, revocable license to use the app and website for their intended purpose. These terms do not transfer ownership of JourneyDeck or permit copying, resale, redistribution, reverse engineering except where the law permits it, or removal of proprietary notices.

Availability and responsibility

We work to keep JourneyDeck useful and reliable, but the service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement.

To the fullest extent allowed by law, the developer will not be liable for indirect, incidental, special, consequential, or punitive damages, lost data, lost profits, or losses caused by unsafe or unlawful use. Nothing in these terms excludes a warranty, remedy, liability, or consumer right that applicable law does not allow us to exclude.

Changes, suspension, and governing law

We may update JourneyDeck and these terms as the service changes. Material revisions will be posted here with a new effective date. Continued use after revised terms take effect means you accept them.

We may suspend access to hosted features when reasonably necessary to protect JourneyDeck, users, or third parties, or when these terms are materially violated. You may stop using JourneyDeck at any time and can manage or delete data using available in-app controls.

Texas law governs these terms, without regard to conflict-of-law rules, except where the law where you live requires otherwise. Mandatory consumer protections and access to courts that cannot lawfully be waived remain in effect.
